These Terms and Conditions are made on behalf of Chicks "r" Us Pty Ltd Trading As Barter & Sons Hatchery (ABN 61 102 749 397). They apply to all purchases made from this website.
The website barterandsons.com.au is owned by Barter & Sons Hatchery. All products listed on this website are described to the best of our abilities and the specifications reflect the information that has been provided to us. All care is taken to ensure this information is correct, but we cannot accept liability for any incorrect information.
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.
We cannot guarantee product availability and products, nonetheless, these items may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order.
The description & images of our products are the copyright property of Barter & Sons Hatchery, or where applicable, our Suppliers or Manufacturers themselves, and specifically you may not use that description and/or images to re-sell the items elsewhere without written permission of the copyright holder.
All orders are prepaid unless prior arrangements are made. When ordering by credit card, your credit card is charged when you place your order. All orders are in Australian dollars. Orders paid for by cheque (Australian orders only) will not be dispatched until such times as the funds have been cleared.
If the credit card payment is declined by your issuer for any reason, we cannot hold goods against your order.
The cost of shipping is clearly indicated for each product ordered, and if calculatable is included in the invoice total. Orders are generally processed and posted in two to three working days, unless noted otherwise on the individual product page.
Transfer of Title and Risk
Title in the goods remains with Barter & Sons Hatchery until payment is received in full. Risk in the goods transfers to you the buyer upon delivery to the address specified on your order.
Our warranty is limited to replacement of the item or refund of the purchase price, at our discretion. Warranties are those made by our suppliers or manufacturers and may vary from product to product.
Limitation Of Liabilities
Under no circumstances will Barter & Sons hatchery be liable for any direct, indirect, special, incidental, consequential, or other damages resulting from any product purchased from us beyond the value of the item purchased, including, without limitation, any lost profits, business interruption, or loss of programs or information. We reserve the right to change any specification, design, model and or other information without notice.
None of our warranties or limitations of liabilty remove your rights under the Consumer Law Act.
